1. Agreement to These Terms

These Terms of Use ("Terms") are a legal agreement between you and Persona Studio: AI Headshot ("Persona Studio," "we," "us," or "our"). By downloading, accessing, or using the app, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the app.

2. The Service

Persona Studio helps users create AI-generated profile portraits from photos they choose to upload. The app may allow you to upload a selfie, select a portrait style, generate an image, save generated portraits, compare results, delete results, and export images for personal or professional profile use.

AI-generated results may vary. We do not guarantee that every generated portrait will be accurate, realistic, flattering, suitable for a specific platform, or identical to your original photo.

3. Eligibility

You must be at least 13 years old to use Persona Studio. If you are under the age of majority in your jurisdiction, you may use the app only with permission from a parent or legal guardian.

4. Photos You Upload

You are responsible for the photos you upload to the app. You may upload photos only if you own them or have all necessary rights and permissions to use them with Persona Studio.

You agree not to upload photos of another person without their permission, and not to upload photos that are illegal, harmful, abusive, deceptive, sexually explicit, exploitative, hateful, or that violate another person's privacy, publicity rights, or intellectual property rights.

5. License You Grant Us

You keep your rights to the photos you upload. By using the app, you grant us a limited, non-exclusive, worldwide license to host, process, transmit, transform, display, and store your uploaded photos and generated portraits only as needed to provide, maintain, secure, and improve the app, provide support, and comply with law.

This license ends when it is no longer needed to provide the service, subject to reasonable backup, security, support, and legal retention needs described in our Privacy Policy.

6. Generated Portraits

Subject to these Terms, you may use generated portraits for lawful personal and professional purposes, including profile photos, personal websites, portfolios, resumes, speaker bios, and social profiles.

You are responsible for how you use generated portraits. You agree not to use generated portraits to mislead others, impersonate another person, create false endorsements, commit fraud, harass others, violate platform rules, or break any applicable law.

AI-generated images can contain errors, artifacts, or unexpected details. You should review generated portraits before using or sharing them.

7. Portrait Credits

Persona Studio may use consumable portrait credits. Credits allow you to submit AI portrait generation requests inside the app. The number of credits required for a generation will be shown in the app before purchase or use.

Credits have no cash value, are not a bank account or stored-value product, and cannot be exchanged for cash. Credits are personal to your Apple ID or app account, if applicable, and may not be sold, transferred, or assigned unless we expressly allow it.

If a technical issue prevents a generation from completing or delivering a result, we may restore the affected credit or provide another reasonable remedy. If a portrait is successfully generated but you do not like the artistic result, the credit may still be considered used.

8. In-App Purchases

Portrait credits may be purchased through Apple's in-app purchase system. Prices, packages, and availability may change from time to time. Any purchase you make through the App Store is also subject to Apple's terms, payment rules, and refund policies.

We do not collect or store your full payment card details. Apple processes payments and may provide us with limited transaction information so we can deliver credits, prevent fraud, restore purchases, and provide support.

Unless required by applicable law or Apple's policies, purchases of consumable credits are final once delivered and used.

9. Refunds

Refund requests for App Store purchases are handled by Apple. If you want to request a refund for an in-app purchase, you should follow Apple's refund process through your Apple account or Apple support channels.

If you contact us about a purchase issue, we may ask for limited transaction information so we can investigate delivery problems, restore credits, or help you understand the next step.

10. Acceptable Use

You agree not to misuse Persona Studio or use it in a way that harms others, violates the law, or interferes with the app. You may not:

• Use the app to create deceptive, fraudulent, defamatory, harassing, hateful, sexually explicit, exploitative, or illegal content.
• Upload images you do not have the right to use.
• Impersonate another person or misrepresent generated portraits as verified identity documents.
• Use the app to create content involving minors in inappropriate or exploitative contexts.
• Reverse engineer, copy, modify, scrape, overload, disrupt, or attempt to bypass security or payment systems.
• Use automated tools, scripts, or bots to access the app without our permission.
• Use generated portraits in a way that violates another service's rules or policies.

We may limit, suspend, or terminate access to the app if we believe you have violated these Terms or created risk for us, other users, or third parties.

11. Our Intellectual Property

Persona Studio, including the app, user interface, design, branding, software, features, text, graphics, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

These Terms do not give you ownership of the app or our intellectual property. You may use the app only as allowed by these Terms and applicable App Store rules.

12. Privacy

Our collection and use of information is described in our Privacy Policy. Please review it carefully to understand how we handle uploaded photos, generated portraits, analytics, crash reports, and purchase-related information.

13. Third-Party Services

The app may rely on third-party services, including AI image processing providers, analytics providers, crash reporting providers, cloud infrastructure providers, and Apple services. We are not responsible for third-party services that we do not control.

Your use of Apple services, including the App Store and in-app purchases, is subject to Apple's applicable terms and policies.

14. Service Availability and Changes

We may update, modify, suspend, or discontinue parts of the app at any time. Some features may depend on internet access, third-party services, AI model availability, device compatibility, or regional availability.

We are not responsible for delays, failures, or unavailable features caused by events outside our reasonable control, including network problems, cloud provider outages, AI service limitations, or App Store service issues.

15. Disclaimers

The app is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

We do not guarantee that generated portraits will meet your expectations, be accepted by any professional platform, increase profile views, improve job opportunities, or be suitable for a particular use.

16. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from or related to your use of the app.

To the fullest extent permitted by law, our total liability for any claim related to the app or these Terms will not exceed the amount you paid to us through the app in the three months before the claim arose, or USD $50, whichever is greater.

17. Apple App Store Terms

If you downloaded Persona Studio from the Apple App Store, your use of the app is also subject to Apple's applicable App Store terms and usage rules. The app is licensed, not sold, to you.

Apple is not responsible for providing maintenance or support for the app. To the extent required by applicable App Store terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. Termination

You may stop using the app at any time. We may suspend or terminate your access to the app if you violate these Terms, create legal or security risk, misuse the app, or if continued access would be harmful to us, other users, or third parties.

Sections that by their nature should survive termination will continue to apply, including sections about ownership, generated portrait use, purchases, disclaimers, limitation of liability, and dispute terms.

19. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles, unless applicable consumer protection laws require a different governing law.

20. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and may provide additional notice in the app or through other appropriate methods. Your continued use of the app after changes become effective means you accept the updated Terms.
